Q. What are my options if I'm not able to conceive naturally?

A. There are several medical treatments like IUI, IVF, ICSI, ovulation induction, and even surrogacy. The right option depends on the cause of the fertility challenge, your health, and personal preferences. It’s best to speak to a fertility specialist to assess your options. Learn more. 

Q. What’s the difference between IUI and IVF?

A. IUI (Intrauterine Insemination): Sperm is placed directly into the uterus around ovulation.
IVF (In Vitro Fertilization): Eggs are fertilized with sperm outside the body and then placed into the uterus.

Q. Is there an age limit for fertility treatments? What about storing embryos or gametes (sperm or eggs)?

Yes, there are legal age limits under Indian law.

Fertility Treatments (ART Procedures)

As per the ART (Regulation) Act, 2021:

  • Both male and female intended parents must be above 21 years and below 55 years of age to undergo ART procedures like IVF, IUI, etc.

 

Surrogacy

According to the Surrogacy (Regulation) Act, 2021, the age requirements are:

  • Intended female parent: Between 23 and 50 years

  • Intended male parent: Between 26 and 55 years

  • Surrogate mother: Must be a married woman aged between 25 and 35 years, and she must have at least one biological child of her own.

 

When it comes to storing embryos or gametes:

  • Embryos can be legally stored for up to 10 years. After that, they must either be:

    • Used for scientific research, or

    • Discarded, but only with the written consent of the individuals/couple involved.
       

  • Gametes (sperm or eggs), on the other hand, do not have a fixed time limit under the law. They can be stored longer, depending on medical reasons, clinic policy, and individual agreements.

 

It's always important to confirm the clinic’s registration and ensure proper documentation about storage timelines and consent.

Q. What happens to unused embryos after IVF?

Unused embryos can be stored for future use, donated, or discarded, based on your prior consent. Clinics must follow safety and consent protocols, and your rights depend on what was agreed at the start of the treatment.

Q. What is altruistic surrogacy?

In India, only altruistic surrogacy is allowed. This means a woman volunteers to be a surrogate without receiving payment, except for medical expenses and insurance. The surrogate must be a married woman with her own child and meet the above mentioned age criteria. Learn more

Q. Can stored sperm or eggs be used after a person’s death?

This is known as posthumous reproduction. While not clearly defined in Indian law, courts have allowed it in certain cases where valid written consent was given. Clear documentation is very important.

Q. How do I know if a clinic is registered or trustworthy?

You can ask the clinic directly if they are registered under the ART (Regulation) Act, 2021. Choosing a licensed clinic is important to ensure proper safety, ethics, and accountability.
